Copyright & DMCA Policy
Will It Scare Me respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we respond to clear notices of alleged copyright infringement that comply with the requirements set out below.
The site hosts user-generated ratings, reviews, forum posts and profile pictures, and the details and cover images of games members add by hand. Other movie, show, book and game metadata and artwork are sourced from third-party providers (see our Terms); takedown requests concerning that data should generally be directed to the originating provider.
If you believe content on the site infringes a copyright you own or are authorized to act for, send a written notice to our designated agent (below) that includes all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material that is claimed to be infringing, with enough detail for us to locate it — ideally a direct URL on willitscare.me;
- Your name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages.
Notices of claimed infringement should be sent to our designated agent:
DMCA Agent, Uplate Agency LLC (Will It Scare Me)
dmca@willitscare.me
Only copyright-related inquiries are handled at this address. For all other matters, contact support@willitscare.me.
Upon receipt of a valid notice, we will expeditiously remove or disable access to the allegedly infringing material and make a good-faith effort to notify the user who posted it.
If you believe your content was removed by mistake or misidentification, you may send a written counter-notification to our designated agent that includes:
- Your physical or electronic signature;
- Identification of the material that was removed and the location at which it appeared before removal;
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the United States, the judicial district in which Uplate Agency LLC may be found), and that you will accept service of process from the person who filed the original notice or their agent.
If we receive a valid counter-notification, we may restore the removed material in 10–14 business days unless the original complainant notifies us that they have filed a court action.
In appropriate circumstances, we will suspend or terminate the accounts of users who are determined to be repeat infringers.
